The presentation will be held from the perspective of the US courts and US law by Howard S. Beltzer and Howard Seife from our New York office.
Lenders and other participants in the capital structure of distressed enterprises are increasingly faced with the prospect of complex multinational restructurings, given the multinational reach of many large businesses in our global economy.
Restructurings of major corporate enterprises increasingly take place on a cross-border basis. In this program, we will examine some of the leading statutory tools which are often employed in such restructurings (US Chapter 11, US Chapter 15, English schemes of arrangement), and will also examine how such restructurings are approached in many of the leading global economies, including Germany, the UK and the US. Examples will be drawn from major recent restructurings of global import. Additionally, recent statutory changes in Europe and elsewhere which may assist in harmonizing cross-border restructurings will be considered.
The goal of the program will be to better assist lenders, secondary claim purchasers and others to proactively assess the risks of a cross-border restructuring in respect of their claims and investments.
