We are pleased to provide resource guides to Canada’s Patented Medicines (Notice of Compliance Regulations), Data Protection and Access to Medicines Regime. The guides provide an understanding of these regimes particularly for the benefit of the innovative pharmaceutical industry.
The Patented Medicines (Notice of Compliance Regulations) provide a summary court procedure to prevent patent infringement. The data protection provisions of the Food and Drug Regulations give eligible innovative drugs a period of market exclusivity. Finally, Canada’s implementation of the 2003 Decision of the WTO provides for the humanitarian export of medicine to the least developed and developing countries.
