Marion Roquette-Pfister is a public law and regulatory lawyer with a particular focus on the life sciences and healthcare sector. She joined the Paris office as partner in 2018

Marion advises public and private entities as well as financial institutions on all aspect of public economy law. She is recognized for her in-depth knowledge and understanding of French public affairs, across all the key regulated industry sectors.

She regularly advises pharmaceutical companies and medical device suppliers on negotiations with public authorities relating to market access, pricing and reimbursement, public procurement issues, and the implementation of financial and regulatory measures applicable to the pharmaceutical industry.

Marion has many years of experience working for major international law firms.

She holds graduate law degrees in public and in civil law from the University of Panthéon Sorbonne (Paris I) and a diploma from Sciences-Po Paris.

    Public Law / Regulatory

    1. High Speed Rail Link France – Spain: advising in connection with (i) the failure of the refinancing of the Concession Contract (ii) the opening in Spain of an insolvency proceeding regarding the Project Company; (iii) an international arbitration procedure; (iv) the termination of the Concession Contract and the transfer of the operation to a public entity
    2. Privatization of the French Regional Airports: advising a major investment fund in the context of the bidding process for the acquisition of a majority interest in Aéroports de Lyon
    3. Rolling stocks: advising a major supplier on public procurement contracts for the supply of rolling stocks
    4. French investment fund – audit PPP portfolio: advising a French investment fund on the audit of its portfolio (investments in 15 infrastructure project companies representing a total of nearly €6 billion of funded works, including a rail PPP and a light rail concession)
    5. Aircraft control: assisting a major stakeholder in relation to a claim against the decision of the Ministry in charge of the Civil Aviation (Direction Générale de l'Aviation Civile) awarding a public contract for the aircraft control to a competitor
    6. Motorways: advising a major stakeholder in relation to the competitive bid structuring and procedures, drafting and negotiation of 8 motorway concessions ( A28, A19, A41, A65, A585, A51, A88 and the viaduct of Millau)

    Healthcare

    1. Advising pharmaceutical companies and medical devices suppliers in the context of the negotiations with the French Pricing Committee (Comité Economique des Produits de Santé, CEPS) in relation to the fixing of price and price decreases;
    2. Advising pharmaceutical companies on the implementation of financial and regulatory measures applicable to the pharmaceutical industry, provided by the Law for the Financing of the Social Security;
    3. Advising pharmaceutical companies and medical devices suppliers in the context of bidding processes launched by public hospitals for the granting of public procurements;
    4. Biologists associations – UNCAM agreement: advising three biologists associations in the context of the negotiation of a frame work agreement regarding pricing with UNCAM (French Social Security);
    5. Advising biomedical laboratories in the context of financial control procedures operated by public healthcare entities (CPAM);
    6. Advising a medical equipment supplier in the context of the development of a new service to public health entities for the supply and maintenance of a high technology medical equipment.
