Bob Greenslade joined the Austin office in 2006 and is currently a senior associate in the Denver office. His legal practice focuses on environmental issues, including state and federal air compliance and permitting, enforcement matters, corporate due diligence and climate change.  Bob has worked on both enforcement and transactional issues, including consent decree negotiation and compliance, climate change issues, environmental audits and corporate due diligence, noncompliance reporting, and Title V and New Source Review permitting and compliance.  Areas of concentration include upstream and midstream oil and gas facilities, refineries and chemical plants, power plants, and manufacturing facilities.

A chemical engineer by degree, Bob was a petroleum and reservoir engineer for Amoco Exploration & Production Company and an environmental consultant with Environmental Resources Management, prior to attending law school and joining.  His prior oil and gas work experience includes reservoir management and planning and oversight for drilling, workovers, and stimulation procedures, including hydraulic fracturing.  As a consultant, Bob worked extensively on environmental litigation support, including criminal defense; Benzene Waste Organic NESHAP; NSPS, Section 114 requests; and other air compliance issues.  He also has technical experience with emissions calculations, TRI and Emissions Inventory reporting, environmental management systems and Phase I Environmental Site Assessments.

    While attending law school, Bob was a member of the Texas Law Review and was inducted into the Chancellors, UT Law's highest honor society, holding the position of Chancellor-at-Large. Bob is also a member of the Order of the Coif.

     Air Compliance and Permitting

    • Representation of an energy utility regarding regulatory compliance issues associated with an 800-MW coal-fired power plant, including citizen suit litigation over permit authorizations and MACT compliance
    • Representation of an oil and gas client regarding air permitting and other environmental issues associated with a proposed tar sand development project and coal-fired steam generation facility
    • Representation of an oil and gas client regarding Clean Air Act source aggregation issues associated with a proposed LNG facility
    • Representation of a refining client regarding multiple audits under the Texas Environmental, Health, and Safety Audit Privilege Act (covering compliance with air permit emissions limits, the Benzene Waste Organics NESHAP, and LDAR, emissions reporting, and other compliance issues
    • Representation of a semi-conductor client regarding disclosures under the U.S. EPA's Audit Policy and the Texas Environmental, Health and Safety Audit Privilege Act
    • Representation of a cement industry client regarding requests to the TCEQ and the U.S. EPA seeking a waiver of NSPS Subpart KKK stack testing requirements

    Enforcement

    • Air emissions enforcement matters before the TCEQ, CDPHE, PA DEP, and SCAQMD for the oil and gas, chemicals, and manufacturing industries
    • Representation of an oil production company regarding the negotiation of a proposed consent decree with the U.S. EPA and the U.S. DOJ and the subsequent implementation of consent decree requirements, including the preparation of compliance plans and periodic reports
    • Representation of a midstream CO2 processing and pipeline company regarding administrative enforcement matters, Title V reporting, multiple audits and disclosures under the Texas Environmental, Health, and Safety Audit Privilege Act, stack sampling, compliance procedures and air permitting
    • Representation of a refining client regarding Section 114 information requests and associated stack testing and multiple U.S. EPA enforcement matters
    • Representation of a natural gas processing and pipeline client regarding numerous TCEQ enforcement issues, including negotiating agreed orders and proposed penalties; representation also included assistance on general compliance issues, environmental audits and Title V reports

    Climate Change/Carbon Sequestration

    • Representation of an energy company regarding Prevention of Significant Deterioration permitting requirements for a proposed LNG facility, including Best Available Control Technology issues for greenhouse gas emissions
    • Representation of a research and development facility regarding the submission of comments on EPA's Greenhouse Gas Emissions Inventory rule and obtaining an exemption from reporting requirements
    • Representation of a client regarding a preliminary feasibility study for a coal mine, coal-to-liquids and carbon sequestration project; representation included a multi-state assessment of environmental, climate change, energy, and mining regulations and incentives for advanced/clean coal and carbon sequestration demonstration projects

    Corporate

    • Representation of an energy company for the construction financing of a 37.5 MW biomass power plant - the transaction was awarded the North American Mezzanine Deal of the Year for 2011 by Project Finance magazine
    • Representation of a large municipality in the acquisition of an 800-MW natural gas-fired combined cycle power plant facility
    • Representation of a private equity fund client in a joint venture with an oil and gas company for development and production of lease rights in the Marcellus Shale and other assets in Pennsylvania and West Virginia
    • Representation of an energy utility company with environmental due diligence and in drafting environmental provisions for a multi-million dollar Note Purchase Agreement

    • Representation of a chemical company client regarding document retention and document production issues associated with a Grand Jury subpoena and an associated FBI investigation concerning waste classification and disposal issues
