Jessica Sykora joined the Houston office in 2008. As a senior associate, Jessica works with the life sciences, pharma and health care litigation group, where she focuses her practice on health law and litigation matters, including representing various hospitals, individual healthcare providers and pharmaceutical companies. Jessica has represented health care clients in professional malpractice suits, labor and employment disputes, pharmaceutical litigation, premises liability cases, complex contract disputes/business torts and in regulatory compliance and licensing issues.

    While in law school, Jessica was a member of the South Texas Law Review. She was on numerous moot court teams, two of which won National Championships.

  • Representative experience
    • Advocate for health care clients in the courtroom: presented and cross-examined witnesses in trial, and successfully argued discovery motions, motions for directed verdict, motions for JNOV, motions for summary judgment, motions for sanctions and Daubert/Robinson challenges to exclude expert testimony
    • Tried four cases to a jury, including a multi-week, complex medical malpractice/breach of contract lawsuit for a hospital client, recovering a verdict
    • Presented and prepared fact and expert witnesses, including physicians and nurses, for trial testimony and deposition
    • Assisted clients with protection of medical records from civil/criminal subpoenas under HIPAA
    • Assisted with RAC audits, including appellate briefing and argument to Administrative Law Judge following MAXIMUS/ Trailblazer appeals
    • Advised clients on impact of statutes such as the U.S. Foreign Corrupt Practices Act (FCPA) and Medicare compliance on their business operations, policies and procedures
    • Conducted FCPA due diligence related to mergers, acquisitions, joint ventures and agents
    • Managed a team of 40 contract attorneys for electronic discovery collection in multi-state pharmaceutical litigation
    • Supervised collection, review and organization of client documents
    • Prepared legal memoranda to clients analyzing possible claims and defenses
    • Interviewed witnesses to gather documents and information
    • Prepared fact summaries and chronologies from documents, witness statements and deposition testimony
