As counsel, Bob Rouder represents domestic and international clients in a wide range of commercial disputes across the United States. Bob has a strong background in health care litigation and the pharmaceutical industry and his litigation practice focuses on Lanham Act claims and unfair trade practices.  His experience involves all aspects of pretrial and trial work, including expert witness identification and preparation, discovery and e-discovery, evidentiary hearings, arbitral proceedings, and trial.  He also counsels pharmaceutical, food, device, consumer product, biotechnology and others clients on advertising and labeling compliance, and marketing and promotional programs like sweepstakes, contests, giveaways and rebates.   Bob is admitted to federal practice in the Northern, Southern and Western Districts of Texas.

Before becoming a lawyer, Bob had a long business career principally in the technology sector. He served in a number of positions including as Vice President of a Fortune 500 company.

    In law school, Bob was an Associate Editor for the Texas Law Review. Bob was admitted to practice law in Texas in 2002.

  • Representative experience
    • Represented leading food company against a competitor falsely advertising its products as equivalent to the clients' branded prescription medical foods.  After a two-week jury trial the case settled on favorable terms
    • Represented manufacturer of life--science equipment company equipment in action against a competitor, alleging violations of California and federal false advertising law.  After initial discovery, the case settled on favorable terms that required the defendant, among other things, to remove all references to the comparison study and to recall and destroy all materials related to the study
    • Assisted in representation of a large pharmaceutical company against competitors falsely claiming to offer generic alternatives to their prescription pancreatic enzymes
    • Assisted in representation of a pharmaceutical company against a competitor falsely claiming to offer a generic version of the prescription seborrhea medication
    • Assisted legal team defending global pharmaceutical company against claims of harm arising from vaccine adjuvants
    • Favorably settled a case in which client sought vindication of her rights to retirement funds, which were denied her by a series of tortfeasors, including her bank
