Biography

Felice Galant practices in a wide range of areas, including complex commercial, securities, environmental, energy, toxic tort, white collar, and business litigation.  Felice has conducted numerous government and internal investigations involving the Foreign Corrupt Practices Act (FCPA), and allegations of insider trading, securities fraud, and bank and accounting fraud, in the United States and countries throughout Africa, Asia, Latin America, the Middle East, and Europe.  She has represented clients in regulatory proceedings and litigation before the Department of Justice, the Securities and Exchange Commission, the Commodity Futures Trading Commission, and the Federal Energy Regulatory Commission.  She also has extensive experience handling parallel civil, criminal and regulatory proceedings across multiple jurisdictions.

Litigation and Arbitration 

  • Defended senior manager of financial institution against civil and criminal securities claims arising from "London Whale" matter, securing complete dismissal of all claims with prejudice
  • Obtained summary judgment dismissal of claims by high stakes trader against securities brokerage firm 
  • Obtained summary judgment dismissal of claims alleging securities fraud and related state law claims against investment firm  
  • Represented energy company in class action under the Commodity Exchange Act alleging price manipulation of NYMEX futures contracts
  • Represented energy company in litigation and regulatory proceedings commenced by the CFTC and FERC for alleged manipulation of price indices for commodities
  • Defended healthcare company in qui tam suit involving False Claims Act and Medicare billing regulations 
  • Secured summary judgment dismissal of claims arising under alleged consulting contract to develop business in India for oil and gas exploration company
  • Obtained pre-discovery dismissal of claims under distributorship contract for oil services company
  • Represented seller of power plant in South America in dispute with buyer under purchase and sale agreement in ICC arbitration 
  • Multiple representations of chemical manufacturers in toxic tort cases, including alleged groundwater contamination and workplace exposure
  • Represented drilling company in contract dispute involving multi-jurisdictional litigation and arbitration and maritime attachment of funds and vessels
  • Represented Jones Act ship-builder in credit crisis dispute in state court and bankruptcy court, securing favorable settlement on first day of trial
  • Obtained pre-discovery dismissal of suit brought under The Death on the High Seas Act relating to explosion on vessel for energy and chemical company
  • Defeated motion for injunctive relief, obtained summary judgment dismissal of claims seeking specific performance of purchase agreement and return of deposit, and secured award of attorneys' fees for owner of New York City landmark building (all affirmed on appeal) 
  • Represented European nation in suit filed by New York developer relating to nation's mission to the United Nations, obtaining summary judgment dismissal of breach of fiduciary duty and breach of contract claims
  • Represented European nation in suit against the New York State Department of Taxation and Finance in challenge to real estate tax laws and conflict with sovereign immunity protections
  • Represented firm clients in 28 USC 1782 proceedings      
  • Represented chapter 11 trustee in entertainment contract dispute with casino and racetrack, resulting in favorable settlement on fourth day of trial 
  • Defeated preliminary injunction motion and secured dismissal of website trade dress infringement claim for live advice Internet company in suit by competitor
  • Recovered attorneys' fees and obtained injunctive relief against Internet "free gift card" outfits for false advertising and trademark and trade dress infringement on behalf of coffee retailer and men's retailer
  • Represented telecommunications company in arbitration with Internet technology firm, involving claims for breach of development agreement and trade secret misappropriation
  • Settled dispute favorably for software company in international arbitration with licensor of credit card processing software for alleged breach of licensing agreement 
  • Tried breach of fiduciary duty, breach of contract, accounting fraud and conversion cases in federal and state courts 


Government and Internal Investigations

  • Conducted internal investigation for South American conglomerate in connection with bribery allegations involving multiple Latin American countries, government contracts and high-level officials
  • Conducted internal investigation regarding revenue recognition under federal securities laws for electronics company
  • Conducted "second request" reviews for technology companies in US and EU antitrust regulatory proceedings
  • Represented healthcare provider in connection with Securities and Exchange Commission investigation of alleged insider trading and Medicaid and Medicare fraud 
  • Conducted internal investigation for multinational company in Indonesia and The Philippines in connection with accounting and taxation issues 
  • Conducted internal investigation for manufacturing and engineering company in Qatar and Morocco in connection with government contracts  
  • Conducted internal investigation for global company in China and Korea in connection with customs, immigration and licensing requirements, and third-party service providers
  • Performed multiple investigations of global company's activities in West Africa, South America, and former Soviet republic in connection with local importation, customs, and permitting laws, third-party service providers, and government contracts   
  • Performed investigations for global firm in connection with business conducted with state-owned entities in Mexico and South America 
  • Develop protocols for and perform FCPA due diligence on merger and business partners for firm clients 
  • Advise compliance officers, audit committees, and internal audit departments on anti-corruption and compliance matters
  • Provide FCPA and anti-corruption training to senior management, employees, and contractors
