Biography

Scott Boucher is a partner in our litigation group, practising general commercial litigation with an emphasis on insolvency and restructuring and estates litigation. He assists clients and other lawyers on a wide variety of matters, including contract and property disputes, insolvency files including receivership, CCAA, bankruptcy and foreclosure proceedings, wills variation claims, and trusts litigation. He has appeared before the Supreme Court of British Columbia, the British Columbia Court of Appeal and the Supreme Court of Canada.

After completing an undergraduate degree at UBC, Mr. Boucher attended law school at Dalhousie University, earning a Schulich Scholarship for academic excellence and community service. He completed summer articles in 2010, before studying at the National University of Singapore on exchange in his third year of law school. He clerked at the Supreme Court of British Columbia in 2012, and completed his full articles in early 2013.

  • Mountain Equipment Co-operative (now 1077 Holdings Co-operative) in its CCAA restructuring involving a pre-packaged sale process (Mountain Equipment Co-Operative (Re), 2020 BCSC 1586)
  • A claimant seeking relief regarding heavy equipment purchased through a receivership (P.S. Sidhu Trucking Ltd. v Elima Enterprises Ltd., 2020 BCSC 1062)
  • Family beneficiaries in a contested wills variation and constructive trust action (Volovsek v Donaldson, 2019 BCSC 1820)
  • Shareholders and directors in a corporate governance dispute (Goldstein v. McGrath, 2017 BCSC 586)
  • The City of Nelson in a historical adverse possession claim (Nelson (City) v. Mowatt, 2017 SCC 8)
  • A creditor alleging fraudulent conduct in a bankruptcy proceeding (H.Y. Louie Co. Limited v. Bowick, 2016 BCCA 256)
  • A lien claimant and creditor bringing a jurisdictional application in a CCAA proceeding (Yukon Zinc Corporation (Re), 2015 BCSC 1961)
  • A secured creditor in a complex and multi-jurisdictional priority dispute (Coutinho & Ferrostaal GmBH v. Tracomex (Canada) Ltd., 2015 BCSC 787)
