Norton Rose Fulbright projects team advises on 800 MWh BESS project in Massachusetts

Global law firm Norton Rose Fulbright represented Flatiron Energy (Flatiron) in negotiating procurement and construction agreements for the Taft Project, a 200 MW / 800 MWh battery energy storage system (BESS) in Uxbridge, Massachusetts.

On September 18, Flatiron signed a master supply agreement with SK Battery America, Inc., a subsidiary of SK On Co., including a purchase order for BESS equipment supply and a long-term services agreement for maintenance for the Taft Project.

The deal marks SK On’s entry into the US BESS market with lithium iron phosphate (LFP) batteries. SK On will supply up to 7.2 GWh of BESS for Flatiron’s projects through 2030 under the agreement, beginning with the supply of containerized BESS units for the Taft Project.

The firm also advised Flatiron in its construction agreement, as well as its operations and maintenance agreement for the project.

Set to reach commercial operation in 2026, the project will deliver power to local communities that rely upon the eastern Massachusetts grid and will be the largest battery energy storage project in Massachusetts.
