Please join us for a thought-provoking discussion led by Mina Matin, Co-Head of Insurance and Partner at Norton Rose Fulbright, on the challenges faced by insurers and insureds when considering what law should govern Bermuda Follow Form insurance policies.

New York law (subject to certain modifications) has long been the favored choice of law to govern Bermuda Form insurance policies. The questions that arise are: Should New York law be removed or modified as the law governing the policy? If so, what consequences arise when determining what choice of law governs the policy?

The presentation will be held in-person in Bermuda and followed by an outdoor networking reception hosted by Norton Rose Fulbright. There will be the opportunity to meet and mingle with your colleagues and enjoy light bites and drinks. We look forward to seeing you there.

Topics

  • The principles which will apply to determine the applicable choice of law in Bermuda Follow Form policies where no express choice of law provision is specified.
  • The legal implications of removing or modifying New York law as the governing law in Bermuda Follow Form policies.
  • The advantages and disadvantages of not including an express choice of law provision in Bermuda Follow Form policies.
  • Other considerations which insurers and insureds should take into account when considering what law governs Bermuda Follow Form policies or dealing with disputes involving choice of law issues.
