United States | April 04, 2023

The United States Department of Justice has withdrawn support for three policy statements that created antitrust safety zones on which the healthcare industry has relied for nearly 30 years. This sends an unmistakable signal to the healthcare industry: consider or reconsider transactions and other collaborations previously protected by the safety zones and take exceptional caution about any information-sharing practices.

In this webinar we will discuss the impact of the withdrawn policies on information-sharing practices, key insights and practical tips for managing material risk in an uncertain enforcement environment.

Topics will include:

  • Assessing anticompetitive risks in exchanges among competitors
  • Demonstrating a pro-competitive rationale for competitor collaborations
  • Evaluating conduct that previously fell into one or more safety zones
  • Analyzing accountable care organizations' compliance with antitrust principles
  • Conducting an antitrust risk assessment and compliance review
  • Developing protocols and compliance training for using shared information
  • Monitoring state AG antitrust actions and enforcement
