Biography

Mlungisi is an employment and labour lawyer based in Durban.  He focuses on all aspects of employment and labour law with particular emphasis on employment equity.  He often provides training to clients and assists them to prepare and implement employment equity plans to achieve compliance.  He specialises in employment equity director-general reviews, compliance disputes and labour court litigation arising from the Employment Equity Act 55 of 1998.

Mlungisi regularly represents clients at the CCMA and Bargaining Councils within the transport, manufacturing, banking and industrial sectors.  In these forums he has successfully dealt with matters including dismissals, collective labour law and unfair labour practice disputes.

Mlungisi obtained his Bachelor of Social Sciences and LLB degrees from Rhodes University.

  • Chaired various disciplinary enquiries involving senior employees and represented clients across multiple industries in arbitration disputes referred by former and current employees.
  • Successfully dismissed a severance pay claim brought by eight applicants against a New Zealand based company with operations in South Africa.
  • Assisted two of South Africa's top listed companies in the food industry in forming their national consultative forum for employment equity and provided advice on compliance with the Employment Equity Act.
  • Provided training on effective workplace discipline, an employer's duties and obligations in employment equity law and the implementation of affirmative action measures and transformation in the workplace. 

Mlungisi has published various articles, in particular interest is an article examining the accrual of interest on arbitration awards in favour of employees titled "Keeping eyes on arbitration awards: Interest applies to backpay" and an article canvassing the duty of consultation in employment equity titled "Consultation is the key to employment equity".
