Chandra Westergaard provides high quality legal advice and effective problem-solving strategies to individuals and companies across the healthcare industry who are facing criminal, civil or administrative government investigations and enforcement actions. Chandra has conducted countless internal investigations and regularly counsels clients on compliance with global, federal and state healthcare regulations and laws. She has extensive experience, as both inside and outside counsel, representing corporations and individuals before the US Department of Justice, the US Department of Health & Human Services Office of Inspector General (HHS OIG), state Medicaid agencies, and state Attorneys General in enforcement actions and agency audits.
Prior to joining Norton Rose Fulbright, Chandra was assistant general counsel and head of investigations for a global, publicly-traded, Fortune 200 healthcare company. As head of investigations, she was responsible for conducting privileged internal investigations across the global enterprise, including allegations of violations of the False Claims Act, Anti-Kickback Statute, Stark Law and Foreign Corrupt Practices Act (FCPA). Chandra was also responsible for the company's response to government investigations and enforcement actions, including qui tam litigation.
As a corporate executive and in-house lawyer, Chandra gained a deep understanding of a client's needs and expectations. She advised senior executives and the company's Board of Directors on litigation matters, incident response, investigations and compliance risks. She also worked with the Compliance and Internal Audit departments to develop and implement compliance risk mitigation strategies. Chandra leverages her in-house experience to provide practical guidance and efficient legal services to her clients.
Before going in-house, Chandra was in private practice as a white collar and healthcare regulatory attorney with an international law firm where she represented healthcare providers, managed care companies and individuals in a wide range of fraud and abuse, compliance and regulatory matters. Representative matters include counseling healthcare providers on compliance with Medicare billing requirements and conditions of participation, conducting compliance-focused due diligence, representing physicians in HHS-OIG exclusion proceedings, and resolving self-disclosures under the HHS OIG's Provider Self-Disclosure Protocol and the Centers for Medicare and Medicaid Services' Self-Referral Disclosure Protocol.
