On March 26, 2020, the Mexican Ministry of Energy (“SENER”) published in the Official Federal Gazette the criteria to determine the superficial survey and exploration method that shall be subject to the regulation on superficial occupation matters (the “Criteria”).

According to the Criteria, seismic superficial survey and exploration activities involving the use of well seismic and in-time repeating seismic shall be subject to the provisions issued by the SENER in June 2016 (the “Land Occupation Rules”), which originally regulated the occupation of land for exploration, extraction and pipeline transportation activities in Mexico. 

As a result of the Criteria, the companies that apply any of the methods mentioned above when conducting superficial survey and exploration activities, shall comply with the Land Occupation Rules, including the obligation to negotiate and execute contracts with landowners in accordance with the procedures and model agreements set forth in the Land Occupation Rules.
