Biography

Lici is a risk advisory, regulatory enforcement and litigation lawyer. She has more than 20 years' experience advising Australian and UK regulators and law enforcement bodies on public law, investigations and civil enforcement proceedings. 

She has held senior in-house enforcement and litigation roles in financial regulation at the Bank of England and in competition and consumer law at the UK Competition and Markets Authority. She also worked closely with government bodies in her previous role as a senior executive lawyer at the Australian Government Solicitor.

Her work in financial regulation included advising on and conducting highly sensitive prudential regulation investigations concerning risk management, governance, outsourcing, operational resilience and integrity. In addition to investigating firms, Lici advised on disciplinary investigations of individuals. In 2023, she delivered the first penalty imposed under the Senior Managers Regime in the UK. She also led on a comprehensive revision of the Bank of England’s enforcement policies in 2024, launching a new model for subjects of investigation to cooperate with the regulator.

Lici’s broader experience includes advising on numerous proceedings seeking civil penalties, injunctions and compliance orders. She has also advised extensively on the use of statutory powers and compulsory information requests. This included acting in challenges to the use of such powers and disputes over confidentiality, privilege, public interest immunity and secrecy provisions.

More broadly, Lici has advised a wide range of government agencies and other public bodies on statutory construction and administrative decision-making. This includes advising on challenges to decisions in New South Wales and Commonwealth courts and tribunals and risk assurance on automated decision-making.

In 2018, Lici completed a Postgraduate Diploma in Laws with Distinction at Queen Mary University of London, focusing on cross-border regulation and dispute resolution. Her dissertation was on digital platform regulation.

  • Advising Commonwealth government agencies on statutory interpretation and decision-making, including on risks of processes to automate high volume decision-making and use of statutory powers relating to product approval.
  • Bank of England – undertaking confidential enforcement investigations into firms and individuals for the Bank of England in its capacity as the UK Prudential Regulation Authority, including the first penalty imposed under the UK Senior Managers Regime - 2023; advising on use of investigative powers and evidentiary basis for exercise of enforcement and supervisory powers; advising on information-sharing and liaison with UK and international regulators; leading on revision of enforcement policies, including government, industry and senior stakeholder consultation and governance.
  • UK Competition and Markets Authority – advising on consumer protection investigations, including the first such proceeding instituted by the Competition and Markets Authority – 2018.
  • AUSTRAC - part of the legal team acting for AUSTRAC in civil penalty proceedings; advice on the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), including on implementing standard operating procedures relating to supervision and enforcement and advice on rule-drafting.
  • Australian Taxation Office – advising on evidence-gathering, particularly expert evidence, relating to one of the first civil penalty proceedings for promotion of a tax exploitation scheme – 2015.
  • Australian Competition and Consumer Commission – several competition and consumer law investigations and proceedings, including appeals to the High Court of Australia on derivative crown immunity and the publisher defence; playing a key role in an ACCC investigation and proceedings concerning currency conversion services – 2015.
  • Advice on use of compulsory powers - advised various regulators, law enforcement agencies and other government bodies on use of and challenges to investigative powers, including compulsory examinations and production of documents, disputes over confidentiality, privilege, secrecy provisions and immunities in the Federal Court, Full Federal Court and High Court. Highlights include several matters for criminal intelligence and law enforcement bodies arising from the multi-agency Project Wickenby investigation into offshore tax arrangements and acting for the Commonwealth of Australia in a Federal Court challenge to the exercise of Royal Commission powers during the Oil-for-Food Inquiry: AWB Ltd v Cole (No 6) - 2006.
  • Australian Prudential Regulation Authority – advising on confidential proposed disciplinary decisions following the HIH Royal Commission – 2005.
  • NSW Office of Fair Trading – acted for the Commissioner for Fair Trading in challenges to licensing and disciplinary proceedings in the NSW Administrative Decisions Tribunal and consumer protection proceedings in the NSW Supreme Court – 2005.
  • Administrative law - merits review proceedings in the Administrative Appeals Tribunal under the Environment Protection and Biodiversity Conservation Act 1999, the Classification (Publications, Films and Computer Games) Act 1995 and the Safety, Compensation and Rehabilitation Act 1988.
