Amanda Town and Richard Whish KC (Hon) discuss the European Commission's online food delivery cartel decision. This resulted in Delivery Hero and Glovo being fined a total of €329 million for unlawful information exchange, market sharing and no-poach agreements.

The case is notable as the first time the Commission has found cartel conduct in the context of a non-controlling minority shareholding. It is also the first Commission decision involving a labour market infringement, with previous such infringements in the EU sanctioned by the national authorities in relevant Member States.

The video includes discussion of the significance of the case, including expected greater focus going forwards regarding potential infringements linked to minority shareholdings and appropriate safeguards to prevent such infringements. It also covers how the case came to the Commission's attention, including that the Commission received information from an individual whistleblower.
