Tel que nous l'avons expliqué dans des articles précédents, avant de procéder à l'embauche d'un travailleur étranger, un employeur doit, sauf exception, obtenir une Étude d'impact sur le marché du travail (ci-après « EIMT ») et une demande de Certificat d'acceptation du Québec.
L'EIMT est un document émis par Emploi et Développement social Canada (ci-après « EDSC ») qui permet à un employeur canadien d'embaucher un travailleur étranger dans le cadre du Programme des travailleurs étrangers temporaires. L'étude faite par EDSC vise à évaluer l'impact potentiel de l'embauche d'un travailleur étranger sur le marché du travail canadien en vertu de divers critères dont le type d'emploi, la disponibilité actuelle de main-d'oeuvre canadienne pouvant remplir un poste donné et l'opportunité que de nouveaux emplois soient créés par suite de l'embauche du travailleur étranger. Une EIMT positive ou neutre signifie que l'embauche d'un travailleur étranger à un poste donné aura un impact positif ou neutre, selon le cas, sur le marché du travail canadien. Certains types d'emplois, visés par des ententes bilatérales, ne sont pas visés par cette exigence.
