Biography

Amy is an intellectual property, insurance, commercial, construction and engineering litigation and dispute resolution lawyer based in Durban.

Amy focuses on intellectual property, insurance, commercial, construction and engineering disputes and advises on the preparation and negotiation of supply agreements for manufacturing clients, as well as assignment and licensing agreements. She has experience in international as well as domestic arbitrations, in relation to disputes arising out of construction projects and supply agreements.

Amy also specialises in copyright and has experience in copyright and trade mark infringement dispute resolution, in domain name dispute resolution, transactional IP, IP structuring, as well as social media take downs involving IP infringements, including on Facebook, as well as through the Internet Service Providers' Association of South Africa (ISPA).

Amy holds a Bachelor of Social Science degree (majoring in Politics and Law) from the University of Cape Town and an LLB degree from the University of KwaZulu-Natal.

  • Grand Baie La Croisette Development Dispute, Mauritius - Advised the client on an urgent application instituted in the High Court of Mauritius by owners of a development, to interdict the construction professional team from certifying further payment certificates, pending the outcome of arbitration proceedings to be instituted between the parties. Arbitration proceedings to recover moneys due to the client after termination of the contract. There were also a number of court applications on related issues.
  • Zola Hospital, South Africa – Represented the client regarding a guarantee issued by the Lombard insurance company on behalf of the Ilima Consortium (a group of companies assembled to perform the work relating to the Zola Hospital). The Department attempted to call up the guarantee on the basis that the contract had been cancelled due to default. We were successful in the High Court in Durban. The Department petitioned the Supreme Court of Appeal for leave to appeal, which recently dismissed the application.
  • Expansion of Mozambican Port, Mozambique - The matter relates to the defence of a claim by MEI Engineering Contractors CC relating to its dis-satisfaction with a determination by the Engineer. TCM and MEI entered into a contract regarding the expansion of the port in Mozambique.
  • National Highways Authority of India Intertoll Project, India – Advised the client on two disputes with the National Highways Authority of India arising out of two contracts for the operation and maintenance of four lane Highways in two states in India.
  • Pipeline and Terminal Tanks, South Africa – Acted for the client in an adjudication relating to the construction of large fuel storage tanks in Island View, Durban. The foundations of some of these Tanks settled during construction which led to construction problems on the tanks. The contract utilised for the construction of the tanks was a NEC contract. Amy is currently involved in a number of other disputes that have arisen in relation to the same contract.
