On 28 November 2023, the High Court ruled in R (Suez Recycling and Recovery UK Ltd) v Environment Agency (the Claim) that the Environment Agency (the EA) had made a material error of law in considering, and denying, a right of appeal against adverse Compliance Assessment Reports (CARs) issued by the EA to Suez Recycling and Recovery Limited (Suez) in 2020.
