Miranda Cole, Lara White and Christoph Ritzer from our Brussels, London and Frankfurt offices are the authors of a chapter on how the interplay between competition and privacy law is affecting online advertising. It was published in the first edition of the Global Competition Review's Data & Antitrust Guide in May 2024. The chapter provides a brief, high-level overview of how online advertising works, looks at the privacy challenges relating to the online advertising ecosystem, examines the competition law challenges relating to online advertising and explores the direct and indirect interplay between privacy and competition law in the context of online advertising.

On 8 May 2025, the Court of Justice of the European Union (the CJEU) delivered its ruling in case C-581/23 (the Ruling), providing guidance on one of the conditions for an exclusive distribution agreement to benefit from the block exemption under Article 4(b)(i) of the 2010 Vertical Block Exemption Regulation (the VBER)1, notably the so-called ‘parallel imposition requirement’.
