Associate Shelby Knutson Bruce joined the Minneapolis office in 2012. Her practice focuses on intellectual property and technology.  Shelby focuses her practice on US and international trademark prosecution and litigation, oppositions and cancellations, copyright counseling, domain name acquisition, counseling clients on the selection and clearance of trademarks, and providing advice and handling disputes involving social media.  Shelby also assists clients with transactional matters, including drafting trademark and copyright licenses and assignments and drafting releases and consents relating to rights of privacy and publicity.  Shelby is a regular contributor to the Norton Rose Fulbright Social Media Law Bulletin.

    While in law school, Shelby served as a judicial extern for the Honorable Ann D. Montgomery, United States District Court, District of Minnesota. She was also a Note and Comment editor of the Seattle University Law Review. In the Spring of 2012, Shelby, as a visiting student, completed the Corporate Institute Leadership Foundations Program at the University of Minnesota Law School. She is admitted to practice law in Minnesota and the U.S. District Court, District of Minnesota .

  • Representative experience
    • Prosecuted hundreds of trademark applications for businesses in a variety of industries
    • Represented clients in contested opposition and cancellation proceedings before the Trademark Trial and Appeal Board
    • Evaluated hundreds of potential marks and conducted availability searches
    • Obtained orders transferring domain names from cybersquatters to clients through ICANN's UDRP proceedings
    • Assisted in handling the trademark policing portfolio for a famous house mark of a Fortune 250 client
    • Provided advice and handling disputes involving all aspects of social media
    • Assisted in handling federal intellectual property cases involving trademarks and trade dress, including drafting pleadings, dispositive motions, and responses and objections to discovery requests
    • Assisted clients with reviewing marketing and promotional materials for compliance with advertising and marketing regulations including FTC .com Disclosures, Green Guides, and Guides Concerning the Use of Endorsements and Testimonials in Advertising
    • Counseled clients on contests and sweepstakes matters
    • Drafted trademark license agreements, coexistence agreements, settlement agreements, and license agreements involving copyrights and right of publicity
    • Coordinated trademark prosecution, oppositions and cancellation proceedings in multiple countries
