Fulbright's White Paper, entitled "The President's Speech and Regulatory Reality on the OCS," which we believe will be of timely interest to you, was written and presented by L. Poe Leggette, Partner-in-Charge of Fulbright's Denver office, on February 2, 2012, at the 2012 OCS Workshop of the OCS Advisory Board, American Association of Professional Landmen, in The Woodlands, Texas.

The paper addresses the segment of President Obama's 2012 State of the Union address devoted to "American-made energy." It analyzes, among other things, how OCS lessees can better manage litigation risks in well permitting and exploration and development plan approvals. The paper also provides a brief historical overview of major policy developments regarding lease sales, and addresses recent lease sales and litigation up through theDeepwater Horizon event, the regulatory environment in its aftermath, and includes extensive data concerning OCS activity.
The paper concludes by urging the industry to engage the government and the public "to identify those policies and requirements that are thoughtful, workable, and necessary, and to separate them from those that are not."
