Meet the team

Our real estate disputes group has resolved high-stakes disputes from coast to coast in virtually every industry segment. Our approach begins with developing a thorough understanding of our client’s business goals and an intense focus on early case assessment and strategy. We closely collaborate with in-house counsel and client leadership to assess and re-assess risks and opportunities and to select and implement litigation strategies calculated to achieving the client’s objectives.

Our real estate disputes team collaborates heavily with our international real estate practice group to approach disputes from a business perspective. We have acted for a wide range of clients including, but not limited to, real estate investment funds, commercial and master landlord/tenants, development corporations, private equity, distressed asset funds, secured lenders, title insurers, sponsors of real estate securities private offerings, retail enterprises and government entities.

Our recent work

  • securing a dismissal for a lessor in a bankruptcy action where the plaintiffs sought to re-characterize a leasing transaction of two power generating facilities as secured financing transactions
  • advising a real estate enterprise in successful arbitration proceedings against tenant-in-common investors
  • securing termination of a national joint venture formed to acquire class-A multi-family properties for syndication to tenant-in-common investors
  • securing an injunction for several financial institutions which froze assets of a large private home builder
  • advising a corporation in a title dispute over the development of a proposed expansion in which title to the property was cleared without delaying construction and development
  • defending the owner of a shopping mall against allegations of code violations concerning a gap in a guard rail that allowed a child to fall from one floor to another resulting in injury
  • advising  power plants, refineries, real estate developers and a paper mill on Enterprise Zones and secured tax abatement agreements
  • securing summary judgment for  a large international oil and gas company concerning the company’s right to condemn an easement where the property owner argued that the company exceeded its authority and the taking severed the subject property
  • advising owners and contractors on environmental matters ranging from allocation of environmental responsibilities and liabilities in the contract, to helping  obtain permits and successfully defending against enforcement actions.
