Biography

Sofia Lopez Bancalari practises in all areas of civil and commercial litigation, including international arbitration and maritime litigation. Her practice covers all aspects of litigation, mediation and arbitration, including providing legal advice, developing litigation strategy, drafting submissions and representing clients before the Quebec courts and the federal courts of Canada.

Sofia's maritime litigation experience includes advising and managing disputes involving marine pollution, collisions and maritime incidents. She has also represented clients in arbitration in ICC, UNCITRAL, LMAA and ad hoc proceedings.

Sofia is fluent in English, French and Spanish.

Matters in which Sofia has acted include:

  • Acting for a Canadian construction company, its joint venture partner and the joint venture vehicle in an UNCITRAL BIT arbitration with a South American state regarding the state tax authority's imposition of income tax and VAT on the joint venture vehicle in breach of the BIT and legal stability provisions of an investment contract

  • Acting for an engineering firm in ICC arbitration proceedings relating to the defence of a construction claim resulting from design services rendered in the context of a major Canadian P3 civil infrastructure project

  • Acting for a civil aviation company in an ad hoc arbitration involving the termination of a contract with a counterparty resulting from the suspension of a development program for a new aircraft

  • Acting for the purchaser of a vessel in a LMAA arbitration involving a claim against the vendor for extensive and serious deficiencies, including engine failure and deficient lifesaving equipment, discovered after delivery

  • Acting for the owner of a terminal involving a claim against the vessel and her owners for the damage caused following the collision between the vessel and the terminal's wharf

  • Acting to defend a charterer of a vessel alleged to have caused contamination damage to liquid food stuffs cargo
