Esclusione dall’obbligo assicurativo per muletti e carrelli elevatori non immatricolati

Il disegno di legge annuale per le PMI, approvato dal Senato il 22 ottobre e ora all’esame della Camera, introduce una deroga all’obbligo di assicurazione per la responsabilità civile verso terzi. In particolare, l’art. 9 stabilisce che i muletti e i carrelli elevatori non immatricolati, quando utilizzati esclusivamente all’interno di aree aziendali, stabilimenti, magazzini o depositi, non sono soggetti all’obbligo assicurativo previsto dal Codice delle assicurazioni private (D. Lgs. n. 209/2005).
La norma modifica il quadro applicativo dell’art. 1, comma 1, lettera rrr), del Codice delle assicurazioni, riferendosi ai veicoli rientranti nella categoria dei carrelli di cui all’art. 58, comma 2, lettera c), del Codice della strada, ossia macchine operatrici destinate alla movimentazione di cose.
