Biography

Esha Kamboj is an associate in the International Arbitration group in Washington, DC. Her practice focuses on complex cross-border disputes, including international arbitration, arbitration-related litigation including enforcement of arbitration awards and agreements and proceedings concerning the Foreign Sovereign Immunities Act, and complex commercial litigation in both state and federal courts. Esha joined the firm's New York office in 2017 and transferred to the Washington, DC office in 2018. Her representation of corporate and individual clients, as well as foreign sovereigns, has spanned a diverse range of industries, including energy, infrastructure, insurance and reinsurance, banking and finance, manufacturing, securities and technology, pharmaceuticals, mortgage services, and real estate.

Esha has taught lectures on international investor-state and commercial arbitration at the Georgetown University Law Center and the International Law Institute in Washington, DC and is a member of the New York International Arbitration Center. 

Esha is admitted to practice in the District of Columbia and in New York, as well as in the U.S. District Courts for the Southern District of New York and the District of Columbia.

Esha currently serves as Chair of the Non-Partner Attorney Committee for the Washington, DC office of Norton Rose Fulbright. She is also a member of Norton Rose Fulbright's Racial Equity Council, which is dedicated to improving the experience of Black personnel at the firm and to support the firm's racial equity, where she plays an active role in the Council's recruiting and retention efforts and initiatives.

At Notre Dame, Esha was an editor of the Notre Dame Journal of International and Comparative Law and served as a Committee Chair for the Student Bar Association.  During law school, Esha spent one semester studying at Notre Dame's campus in London, where she held an externship with a U.S. immigration law firm and focused her curriculum on international law courses including international comparative law and international trade.  She also spent one semester in Washington, DC where she held an externship with the Constitution Project, a bipartisan non-profit lobbying group focused on federal policy changes.  Esha also interned at the United States District Court for the District of New Jersey in Trenton, New Jersey.   

At the University of California, Santa Barbara, Esha graduated with high honors and in the top ten percent of the College of Letters and Science, earning a double major in Global Studies and French.

International Arbitration and Arbitration-Related Litigation

  • Represented foreign sovereign in multi-jurisdictional recognition and enforcement proceedings arising out of ECT proceedings in courts in the US, England, Sweden, Belgium, and the Netherlands, with amount at issue exceeding $500 million
  • Represented foreign sovereign in at least five miscellaneous proceedings for discovery in aid of foreign proceedings pursuant to 28 U.S.C. § 1782
  • Represented international conglomerate claimant in $350 million commercial dispute in the financing sector in long-running LCIA arbitration in London, which has resulted in multiple interim awards in claimant's favor
  • Represented international mortgage services company in ICDR proceedings against mortgage provider concerning breach of contract for processing services
  • Represented insurance company in ARIAS proceedings with respect to reinsurance dispute concerning payments made to insured, with amount at issue exceeding $30 million
  • Represented a foreign corporation in AAA proceedings in dispute against international service provider to biopharmaceutical industry concerning pharmaceutical manufacturing technology 
  • Advised domestic technological services firm concerning avenues of recourse in connection with an arbitral award that was issued in its favor but later vacated   

Litigation and Commercial Disputes

  • Represented foreign sovereign plaintiff in litigation against investment advisor and group of companies for aiding and abetting fraud and conspiracy to commit fraud under New York law, and unlawful means conspiracy under English law
  • Represented high net worth foreign individuals in multi-jurisdictional dispute concerning the misappropriation of over $1 billion in familial assets, including preparing and filing RICO action and liaising with counsel in concurrent proceedings in the courts of England, Monaco, Panama, Lichtenstein, and Latvia
  • Represented US individual in suit against US Department of Treasury in the US District Court for the District of Columbia concerning wrongful designation of individual on OFAC list of Russian oligarchs, which resulted in removal of individual from list
  • Represented high net worth individual in successful trial in the US District Court for the District of Columbia against insurance company to obtain damages for millions of dollars in attorneys' fees following years of contentious litigation
  • Represented energy commodities trading firm in dispute against Federal Energy Regulatory Commission concerning alleged market manipulation, resulting in favorable settlement for client
  • Represented US individual in federal criminal proceedings following 23-count indictment alleging claims of fraud and conspiracy to commit fraud under federal law
  • Represented well-known photographer in dispute concerning theft of high value prints from art gallery
  • Represented medical services company in commercial dispute with healthcare company concerning sale of COVID-19 products
  • Assisted with reviewing and translating French documents submitted in ICC and CCJA proceedings concerning a dispute between the Republic of Niger and a foreign financial services company
  • Assisted with liaising in French with bank representatives in Côte D'Ivoire concerning real estate property located in that region on behalf of US individual
