Biography

Carina Wentzel is a planning lawyer based in London. She acts for a range of clients, including private developers, institutional investors, charities, retailers, utility companies and student accommodation providers.

Carina's experience includes strategic advice on planning applications, development consent orders, permitted development rights, the Community Infrastructure Levy, and compulsory purchase and compensation. She also advises on planning appeals, judicial review claims, statutory challenges and enforcement and regularly negotiates planning and highway agreements and advises on acquisitions and disposals (single properties and portfolio sales).

Carina has written for publications including The Sunday Times, PrimeResi and LexisNexis. She is also a regular public speaker, with recent examples including seminars for the Royal Institution of Chartered Surveyors on changes of use and viability.

  • On the proposed redevelopment of designated employment land to deliver a 360-bed student accommodation scheme with associated infrastructure.
  • A leading student accommodation provider on the strategy and agreements required to widen occupation restrictions for a portfolio of 24 properties to enable short-term lets to non-students, thereby generating additional revenue.  Also acted on multiple acquisitions and disposals of properties (including finance and forward funding).
  • The freeholder on the redevelopment of a Grade II-listed trophy asset (including advice on agreements with the anchor tenant to govern the works).
  • A statutory undertaker on the enhancement of operational land (including the availability of permitted development rights).
  • On schemes across England, including Camden, Islington, Lambeth, Southwark, Westminster, Kensington and Chelsea, Hammersmith and Fulham, Merton Elmbridge, Guildford, Chichester, Dartford, Dudley, Fenland, Kidderminster, Liverpool, Oxford and Portsmouth, negotiating highway and planning agreements (including affordable housing obligations).
  • On two section 288 High Court challenges concerning an Inspector's decision to uphold the refusal of two Certificates of Lawfulness.
  • An investor landlord on an appeal against an enforcement notice concerning a mixed-use shisha bar and restaurant.
  • A London-based hotel group in an appeal against an advertisement discontinuance notice (with heritage aspects).
