Major changes to the Competition Act

On 12 July 2019 the vast majority of the provisions of the Competition Amendment Act, 2018 came into immediate effect.  The main intention behind many of the changes to the law is to open up opportunities for historically disadvantaged South Africans to enter various sectors of the economy and compete on an equal footing.

In this session we will discuss some of the most controversial changes to the law.  This includes the separate approval process for investment by foreign firms that may impact on national security, the new buyer power provisions designed to protect businesses selling to dominant purchasers and the changes to the price discrimination provisions intended to ameliorate disadvantages that small and medium firms may have in negotiating their supply terms.

The changes to Competition legislation will impact all firms doing business in the country. Businesses need to check whether their current practices align with the new laws, staff have to be trained on new requirements; and compliance materials need to be updated.
