RESUMO: Este artigo é uma análise crítica da aceitação da renúncia tácita à arbitragem por parte da
jurisprudência venezuelana. As críticas se organizam em dois grupos: primeiramente, do ponto de vista
do direito das obrigações. Em segundo lugar, do ponto de vista da legislação sobre arbitragem. O objetivo
é contribuir com a reflexão que objetiva recolocar esta rara avis do direito arbitral venezuelano em seu
devido lugar de origem.

arbitration. The critics are organized in two groups. Firstly, from the obligation law perspective; secondly,
from the arbitration law perspective.
