Paul has 30 years' experience in liability and personal injury litigation, acting for a number of years on behalf of plaintiffs and then in the last 25 years on behalf of defendant insurers and self-insured entities. His areas of expertise are liability insurance (public and products) including complex liability matters, catastrophic and major claims; general insurance; and commercial litigation. Paul has defended public liability claims on behalf of large construction companies; shopping centres; hotels, pubs and clubs; local government; and security companies. Paul is well versed in the issues arising out of such claims including contractual, insurance indemnity and workers compensation recovery issues, together with a thorough knowledge of the Civil Liability Act 2002 (NSW).
Paul has extensive experience in health liability claims. He acts on instructions from medical defence insurers in representing doctors in the defence of health liability claims including catastrophic injury claims.
Paul has acted in a wide variety of health liability matters involving the liability of general practitioners and medical specialists in such matters as delayed diagnosis of cancer (eg prostate, breast, bowel, throat, myeloma and melanomas), misdiagnosis of cardiac symptoms resulting in adverse outcomes (including death), adverse outcomes in surgery (eg bowel perforations in gynaecological procedures and delayed diagnosis of post-operative infection) misdiagnosis of pulmonary embolism resulting in death, anaesthetic adverse outcomes (including death), failure to diagnose testicular torsion, poor outcomes resulting from ENT surgery, delayed diagnosis of neuropathy (eg transverse myelitis and CIDP) and birth cases involving injury to mother or child.
