Biography

Polly Cheung is a property lawyer based in Hong Kong. She specialises in property and probate related matters, contentious and non-contentious.

Polly provides a wide range of services in relation to property such as conveyancing, mortgages, tenancies and leases for clients including local and multi-national corporate companies. She conducts due diligence works on properties and tenancies for IPO purposes.  Polly also gives advice on making wills and probate applications including resealing of foreign grants.

Polly Cheung joined our Hong Kong office in 2009.

Family, trust and probate disputes

·       Advise a sole executor of a late property tycoon and well known legal practitioner in Hong Kong in applying for revocation of an earlier grant of letters of administration and then an application for probate from the Probate Registry, dealing with potential dispute with and challenge from one of the beneficiaries.

·       Advise a co-executor of an estate of a prominent tycoon worth billions in dealing with the estate and safeguarding the interest of the deceased's estate on various issues: conflicts of interest of a fellow executor and of a firm of solicitors acting for both the fellow executor and the estate; duties and rights of executors; rights of beneficiaries to information, negotiating for terms of settlement agreement and handling incidental property matters, namely transfer of a house at the Peak and an entire building in Tsimshatsui, Hong Kong.

·       Act for an administrator of an estate worth millions in obtaining the grant of Letters of Administration from the Probate Registry; instituting actions in the High Court to vacate the caveat issued by a defendant and to recover control and possession of the deceased's assets including property holding companies beneficially held by the deceased and foreign landed property held by the deceased, advising and handling incidental property and corporate matters, recovering damages from the defendant by obtaining an order for sale of her residential unit and selling the same as a charger in a public auction.

·       Act for a wealthy client in his establishment and operation of a family trust including the proposed retirement of an existing trustee and appointment of a new trustee.

·       Act for an ex-wife in a divorce action for finalising a consent order in (inter alia) recovering matrimonial home and other properties and the transfer of such properties to her own name including application to the Stamp Duty Office for exemption of payment of stamp duty.

Real estate

·       Act for a purchaser in the purchase of an industrial building in consideration of HK$475 million for redevelopment.

·       Act for a local developer company in acquisition of several residential units in a building for future redevelopment purposes.

·       Act for a purchaser in the purchase of several plots of land in Yuen Long for the purpose of redevelopment.

·       Act for a bank in re-financing to a corporate in the sum of a syndicated loan of HK$9,600 million by way of (inter alia) a mortgage over an entire commercial building in Wanchai, Hong Kong.

·       Act for a tenant in negotiating and reviewing a long-term lease (within options to renew and right of first refusal) of an entire industrial building at the initial monthly rental of over HK$3 million.

·       Act for a Hong Kong listed company in relation to compensation in the sum over RMB56 million for the removal of a factory and termination of the agreement relating to the use of the land and factory in the PRC.
