Biography

 

Andres Garin has extensive experience in legal research and written advocacy and has appeared before all levels of courts in Quebec as well as the Federal Court, the Federal Court of Appeal and the Supreme Court of Canada. Mr. Garin typically works on complex and high-profile matters raising novel legal issues. In addition to working on large commercial disputes and class actions, Mr. Garin is frequently involved in disputes that call on his experience in constitutional and administrative law. Mr. Garin has extensive experience in Supreme Court of Canada practice and appellate advocacy.

From 2010 to 2012, Mr. Garin had the privilege of serving as executive legal officer to the Right Honourable Beverley McLachlin, PC, Chief Justice of Canada. In addition to English and French, Mr. Garin speaks Spanish.

Mr. Garin has acted as counsel or co-counsel before the courts for the following clients:

  • Bombardier Inc. in an appeal before the Supreme Court of Canada concerning a claim of discrimination based on the Quebec Charter of Human Rights and Freedoms
  • A federally regulated undertaking on a number of class actions raising constitutional issues relating to the application of provincial consumer protection legislation 
  • The Advocates' Society as an intervener before the Supreme Court of Canada in an appeal addressing the existence of solicitor-client privilege in respect of accounting records held by lawyers
  • Air Canada in an appeal before the Supreme Court of Canada concerning the application of the Montreal Convention, an international treaty, to a damages claim under the federal Official Languages Act
  • Hydro-Québec in the application by Churchill Falls Labrador Corp. seeking the revision of the pricing terms of the long‑term supply contract between Hydro‑Québec and Churchill Falls
  • Iron Ore Company of Canada in connection with a claim brought by two aboriginal communities seeking damages for alleged interference with aboriginal rights and aboriginal title
  • Biogen Inc., in the judicial review of a decision of the commissioner of patents
