Biography

Kelly Moffet-Burima practises in our litigation group. Her practice focuses on three main areas: complex commercial litigation, construction litigation, and professional liability.

Kelly has acted in a broad range of matters, including contractual disputes in the energy and construction sectors, fraud claims, actions involving breaches of fiduciary duty and breaches of confidence, lien claims involving both owners and contractors, and professional negligence actions where she defends architects, engineers, lawyers, and financial advisors.

Kelly has appeared at all levels of court in Alberta. She has also acted as counsel in several arbitrations and mediations.

Commercial Litigation

  • NEP Canada ULC v. MEC OP LLC, 2017 ABCA 405. Successfully defeated an appeal of a trial decision in NEP Canada ULC v. Merit Energy Company LLC et al., 2017 ABQB 28
  • NEP Canada ULC v. Merit Energy Company LLC et al, 2017 ABQB 28. Successfully defeated a claim in a trial of an issue, dealing with the allegation Merit had conspired to conceal an engineering report that NEP contended contained information negatively influencing the value of certain shares prior to the closing of Merit's sale of those shares to NEP
  • Acted as co-counsel on a private arbitration regarding appropriate payments under an offgas agreement
  • Acted as co- counsel on a private arbitration in a dispute regarding a share purchase transaction
  • Acting as counsel for a large breach of fiduciary duty and breach of confidence dispute in the oilfield waste sector

Construction Litigation

  • Currently acting as project counsel for a large P3 infrastructure project in Alberta
  • Currently acting as counsel in a private arbitration arising out of a contract dispute relating to a large P3 transmission infrastructure project
  • Acted as counsel for large contractors in builders' lien disputes in construction and oil sands project disputes
  • Acted as counsel for owners in numerous lien disputes involving multi-million dollar quantums
