Samantha (Sam) Jenkins practises commercial litigation and dispute resolution, focusing on construction law, Indigenous law and administrative law.
Sam has a broad range of experience in dispute resolution in the infrastructure development and construction industry. She regularly advises on lien claims (on behalf of owners, contractors and subcontractors), schedule delay and productivity claims, engineering and design claims, and change management claims. Sam recently completed a 15-month secondment with TC Energy during which she supported the execution of a major infrastructure project.
Sam's work on infrastructure development includes advising clients on the scope and content of the duty to consult with Indigenous peoples and related best practices, project development on reserve lands and traditional territory, ESG project financing requirements (including relating to the Equator Principles and IFC Performance Standards), joint venture and impact benefit agreements with Indigenous communities and organizations, and risk mitigation. She has also assisted with judicial review applications and civil litigation based on claims relating to Indigenous rights.
Sam has advised regulatory decision-makers, parties who appear before regulatory decision-makers, and parties challenging regulatory decisions through appeal and judicial review procedures.
Sam has represented clients at all levels of Alberta courts, the Federal Court, the Federal Court of Appeal, and the Supreme Court of Canada. She has also acted on matters before the Alberta Energy Regulator and the Land and Property Rights Tribunal.
