Kelly Davies is a lawyer based in Sydney and is the head of the power sector practice in Australia. She focuses her practice on the development, acquisition and financing of energy projects. She works closely with energy clients on all aspects of their business and advises on energy transactions both internationally and domestically across the energy sector.

She has advised clients across all levels of the power sector including generators, producers, transmission and distribution network operators, retailers and regulators. She has extensive experience on PPAs across a number of jurisdictions globally including the UK, Africa, Europe, the Middle East, Asia and Australia.

Her recent experience includes advising on a number of renewables projects in Australia across different States and in PNG and Fiji.  Kelly has a broad and deep understanding of the IPP and power purchase agreement markets and project risk and deliverability on a contracted and merchant basis. Her recent experience acting on a number of renewables projects gives her a depth of understanding about the key issues on these projects and the timely implementation of solutions to align debt and equity risks and enable these projects to be developed.

  • City of Sydney - advising in relation to its tender procurement process for renewable electricity and green products to satisfy its increasing sustainability goals over the next 10 years (ongoing)
  • A large property investor with NEM-wide assets - advising on its contractual arrangements with its preferred retail provider on a sleeved basis to provide renewable electricity and enable surrender of green products procured under alternative arrangements with the sleeved retailer of choice
  • Toowoomba Regional Council - advising on its procurement process for the development of a royalty based Landfill Gas Utilisation Project and associated power offtake arrangements
  • SSROC – advising one of the Councils on its increasing requirements and current commitments under the SSROC structure and effective sleeving arrangements with Origin
  • Allianz and Nephila Climate – advising on first solar proxy-revenue swaps globally for the Susan River, Childers and Nevertire solar farms and first Australian wind proxy-revenue swaps with Visy and Orora for the Lal Lal wind farm and subsequent PRS model offtakes (ongoing)
  • Snowy – advising Snowy on its procurement of 400-800MW of renewable energy generation (ongoing)
  • Advising a confidential bidder on its bid for the Westpac corporate PPA
  • Zen PPAs – advising Wirsol in its PPAs with Zen Energy for its Wemen and Clermont solar projects
  • UNSW – advising UNSW on its tender for the large scale solar PV corporate PPA procurement for up to 93GWh of power from renewable energy projects
  • NSW Department of Industry – advising NSW Department of Industry on the implementation of the large scale solar PV PPA procurement for up to 50MW from projects which have been successful in the ARENA LSS funding round. Our role has included preparing a draft LGC supply agreement
  • Telstra PPA – advising RES on its corporate PPA with Telstra – the first of its kind in the Australian market and setting a benchmark for similar deals
  • Telstra PPA Club – advising RES and Macquarie on its "club" model corporate PPA with Telstra for the 226MW first stage of Murra Warra wind farm
