Dietrich Marquardt is a competition/antitrust and regulatory lawyer based in Sydney.

He acts for Australian and international corporate clients on all aspects of competition law, including in relation to transactional, contentious and advisory work. He is highly commercial in his approach and has great rapport with clients. Dietrich regularly advises on the regulatory and competition aspects of highly complex, multi-jurisdictional matters, and consistently delivers outcomes that exceed clients' expectations, resulting in achievement of significant strategic and commercial objectives.

Dietrich has extensive experience advising on complex domestic and cross-border merger clearances, third party access regimes, anticompetitive conduct, international trade regulations, as well as advising on other collaborative arrangements within the bounds of competition law. He also has experience representing clients in relation to cartel conduct investigations and immunity applications. Dietrich is recognised for his lateral thinking, deep knowledge and technical expertise across a range of industries, including: FMCG, infrastructure, automotive, life sciences and healthcare, digital and technology.

Additionally, his technical ability extends beyond 'pure' competition law, given his detailed understanding of Technology, Media & Telecommunications law in various jurisdictions, having acted for clients on a number of advisory and transactional matters, including in relation to M&A/JVs, infrastructure rollouts, satellite and tower deals, market entry, and accessing spectrum, whilst developing and advising upon strategies to mitigate the risks associated with such matters.

Dietrich has been recognised as being one of the "Ones to Watch" in the Competition Law space, in the 2023 and 2024 edition of Best Lawyers in Australia.

  • Sandvik AB - acting for Sandvik AB in relation to the Australian component of its global acquisition of Schenck Process Group, including in relation to obtaining Foreign Investment Review Board approval and ACCC clearance.
  • Sandvik Australia Holdings Pty Ltd - acting for Sandvik in relation to its acquisition of advanced optimisation and services company, Polymathian Industrial Mathematics.
  • Sandvik Australia Holdings Pty Ltd - acting for Sandvik on its global acquisition of Deswik Group Pty Ltd. This included advising on the Australian merger regime, as well as preparing and filing an application with the Australian Foreign Investment Review Board, and notifying the Australian Competition and Consumer & Commission.
  • Patrizia AG - provided advice in relation to all regulatory approval requirements and competition considerations in relation to Patrizia's acquisition of infrastructure investment manager Whitehelm Capital.
  • Sandvik AB - acting for Sandvik on its EUR 943 million acquisition of DSI Underground, a global leader in ground support and reinforcement products, systems and solutions for underground mining and tunnelling industries. This included providing comprehensive advice on the Australian merger regime, as well as preparing and filing an informal merger clearance application with the Australian Competition & Consumer Commission.
  • Digicel Caribbean Limited - advising and acting for Digicel in relation to the creation and implementation of a highly complex US$100 million full radio access network (RAN) sharing arrangement for mobile telecommunications in the French West Indies. The deal involved the statutory demerger of Digicel's existing business (and separation of Digicel's network and retail businesses) to create a special purpose network company, followed by the sale of shares in that company to create a 50:50 joint venture.
  • Megaport Limited - advising on the legal and regulatory issues associated with the introduction of Megaport's Virtual Edge product in several jurisdictions, as well as provide guidance on local regulatory regimes in various jurisdictions.
  • Kacific Broadband Satellites Group (IJGlobal Awards 2019 Asia Pacific Telecoms Deal of the Year) - providing regulatory advice on credit facilities totalling US$160 million to finance the construction, launch, ground system and initial operation for "Kacific1", a Boeing-built next-generation high-throughput Ka-band satellite.
  • PayPal Inc. - advised and obtained clearance from the ACCC on its US$4 billion acquisition of Honey Science Corporation across multiple jurisdictions.
  • Thales Australia Limited - providing competition advice in relation to various matters, including complex supply and collaboration agreements.
  • China Mengniu Dairy Company - acting for China Mengniu on its AU$1.5 billion acquisition of Bellamy's Australia by way of a recommended scheme of arrangement. China Mengniu Dairy is one of the leading manufacturers of dairy products in China and is listed on the Hong Kong Stock Exchange. Bellamy's is a globally recognised Australian organic brand business, selling organic food and infant formula products for babies and toddlers.
  • GlaxoSmithKline plc - acting for GSK in successfully obtaining merger clearance from the ACCC in a global transaction in which GlaxoSmithKline plc has reached agreement with Pfizer Inc to combine their consumer health businesses into a new world-leading Joint Venture, with combined sales of approximately US$12.7 billion.
  • Representing a major financial institution during the course of a regulatory investigation into alleged anticompetitive practices and collusive conduct in the market for foreign exchange products.
  • NBN Co - representing NBN in negotiations for an access license with the Commonwealth Department of Defence allowing NBN to roll-out its network to and access 400 Defence infrastructure sites, as part of a $16.2 million contract.
  • Acted for a variety of clients in respect of merger clearance applications, as well as providing merger clearance prospects advice, across a range of industries (including healthcare, infrastructure and pharmaceuticals).
  • Advising clients in the pharmaceutical and power and utilities sectors in relation to aspects of compliance with Australia's competition laws, as well as industry and state/territory-specific regulation.
