Biography

Sarah Wong is a construction and engineering lawyer based in Melbourne.

Sarah is passionate about finding pragmatic and commercial solutions to our clients' problems across the lifecycle of their projects.  She specialises in resolving project delivery issues and disputes involving contractors and developers.  She has had extensive experience in claims for payment and adjudication applications under Security of Payment legislation across a number of states.  She is also advises clients at the beginning of a project, where her experience in dispute resolution has helped shaped her thorough and realistic approach to preparing and reviewing project documentation.

Sarah previously worked in Adelaide, and is familiar with the construction market and statutory requirements of South Australia.

Sarah's areas of expertise include drafting and reviewing contracts, advising on project delivery issues, strategizing on dispute resolution, and preparing Security of Payment and Court documentation.

Front End Experience

  • Reviewed and advised on contracts for local and national head contractors and subcontractors on mid to large scale commercial and residential projects.
  • Prepared tailored construction contracts (amended Australian Standards and short forms) for supply, design, installation, construction and consultation.
  • Advised on project methodology, compliance and risk allocation, including advising a local company on a joint venture with an ASX-listed mining company, and advising a South Australian contractor on an Interstate project.

Back End Experience

  • Prepared payment claims and schedules, and adjudication applications and responses for local and national subcontractors and head contractors under relevant Security of Payment legislation.  
  • Advised subcontractors and head contractors on their rights in relation to registering liens, subcontractor's charges and suspension in the context of Security of Payment.
  • Assisted in successfully defending an application to the NSW Supreme Court regarding multiple Security of Payment adjudication applications.  Work involved detailed legal research into issue estoppel and abuse of process, preparation of briefs and liaising with Counsel and generally assisting in the conduct of proceedings.
  • Advised and acted for builders and owners in residential and commercial disputes regarding their statutory and common law rights in relation to payment and defective work.
  • Advised on project delivery issues such as claims for delay, variations, extensions of time and security for commercial and residential developers.
  • Acted for manufacturing companies in relation to large Federal Court claims for defective design and construction of buildings and machinery against local and international entities. Work included drafting detailed pleadings, defects schedules, chronologies and affidavits, conducting legal research, extensively reviewing documents for disclosure, engaging expert witnesses and legal counsel, and attending settlement conferences and interlocutory hearings.

Other areas of law

  • Acted for a South Australian manufacturer in relation to a review of a decision of the Minister of Health to de-register a medical device. Work included legal research on statutory interpretation, preparation of material for trial, engaging and consulting with expert witnesses, and drafting outlines of argument and submissions for interlocutory and final hearings.
  • Advised liquidators, companies and individuals on matters involving insurance claims, preference claims, debt recovery, employment issues and IP infringements.
