Biography

Benjamin Gunter is a commercial government lawyer in the Commonwealth Government group and has experience advising on project delivery models, procurement and tendering, contract drafting and interpretation, commercial negotiations, settlement arrangements and dispute resolution, including adjudication and mediation.

  • Department of Defence (ICTPA Refresh)  advising in relation to Defence's ICTPA Refresh project including the preparation of the draft documentation for the refreshed contract suite.
  • Department of Defence (ERP Program) – advising on the Defence ERP program, the approximate $1 billion ICT led business transformation program being conducted by Defence in line with its first principles review. This program will rely on a number of partners including strategic partners, technology partners, organisational change partners, and system integrators to deliver the major reform of Defence's ICT systems and the system and processes underpinning it.
  • Department of Defence (EIM Program)  advising Defence in connection with its Enterprise Information Management Program. This is a "first principles" transformation program, which will see Defence's information management and data-related systems and processes re-engineered, integrated and modernised over the next 3 – 5 years.
  • Department of Defence (Satellite Services Contract Re-Negotiation)  advising Defence on the re-negotiation of the Contract entered into with Inmarsat Australia for the supply of Inmarsat Satellite Services required to operate in-service Defence Inmarsat SATCOM terminals.
  • Department of Defence (SEA1442 Phase 4 Maritime Communications Modernisation)  advising Defence in connection with the negotiation of the contract for the ongoing Support of the upgraded communications capabilities in the eight Anzac Class Frigates.
  • Infrastructure Ontario and Metrolinx, Canada – advising Infrastructure Ontario in connection with a Project Alliance for the reconstruction of parts of Union Station in Toronto, Canada. The collaborative Alliance model is being used due to the complexity of the project, and will be the first Alliance project undertaken in Canada.
  • Transport for NSW – advising Transport for New South Wales on stage 2 of the $4.3 billion More Trains, More Services program. This included assisting the team with providing high level strategic advice on delivery and contract options as well as assisting in providing advice on the project structure, as well as assisting in the preparation of the EOI and RFT documentation, including the Incentivised Project Delivery Partner Agreement. 
  • Local government – acting for a local government client in relation to the design and construction of a water treatment facility. This included advising on claims management in relation to time, quality and cost, as well as performance more generally (including termination and de-scoping rights available to council).
