Biography

Max Kosmala specialises in all aspects of non-contentious (front-end) construction law within the following sectors: commercial, residential, government, retail and regeneration. He has a wide range of experience in Australia and the United Kingdom acting for both public and private sector clients in the drafting, negotiation and administration of a range of construction and engineering contracts. He has considerable experience working on the various standard form building and engineering contracts in addition to development management agreements, consultant appointments (bespoke and industry forms), collateral warranties, bonds and guarantees.

  • Advised a utilities provider on the delivery strategy for a combined dam, pipelines and irrigation scheme in North Queensland.
  • Advised a local council on probity and procurement processes in relation to its proposed sale of assets.
  • Advised a university on the collaborative project agreements for the design, construction and delivery of an allied health precinct in Far North Queensland.
  • Acted for councils on various procurement projects, including the development and refresh of construction and procurement contracts.
  • Advised on the development of complete suites of construction management procurement documentation, including trade contracts, consultant appointments, collateral warranties and ancillary security documentation for a number of major construction/regeneration projects in central London by a developer client:
    • two residential towers of 50 and 55 storeys, becoming two of the three largest structures in Canary Wharf
    • mixed-use development of 870 residential units alongside retail, leisure and office facilities (including the world's first sky-pool that is suspended between two buildings next to the new US Embassy)
    • 12 acre island neighbourhood consisting of 1600 residential units and cultural exhibition space, home to the English National Ballet and London Film School
    • 804 new homes including commercial, retail and cultural exhibition space
    • 1,500 new homes, two new schools and a theatre
    • riverside neighbourhood comprising 804 new homes, commercial and educational space and dry dock located directly by the River Thames
    • multi phase residential led mixed-use scheme including 3,400 apartments and townhouses
    • 769 residential units, public and communal open spaces and basement car parking consisting of 10 buildings ranging from 8 - 16 storeys in height
  • Reviewed and advised on the construction security in respect of the design and construction of a new build student accomodation project.
  • Advised a national house-builder client on the development of its standard form design and construct contracts.
  • Advised on the construction package for the forward purchase of a new build office building by a council from our developer client.
  • Advised on the updating of a standard form suite of construction documents, including building contracts and consultancy agreements for the development of the new primary school. 
  • Drafted the bespoke design and construct contract and letter of intent for a retail client's refurbishment of their flagship highstreet store.
  • Advised and negotiated an architects consultant terms of appointment for various projects tendered for, utilising both bespoke and industry standard forms.
  • Advised on a contractor client's sub-contract agreement terms and underlying forms of collateral warranty as part of its tender submission.
  • Regularly advised on construction due diligence excercises for a panel of banks/lenders.
