Nicole Yu

Biography

Nicole is an associate in our risk advisory team based in Canberra. She assists public sector clients in relation to a diverse range of regulatory investigations and litigation matters. She has prior experience as an in-house lawyer at the Australian Government Department of Health and Aged Care and its portfolio agency, the Therapeutic Goods Administration. Her practice primarily involves conducting litigation in areas including administrative law and health law. Nicole holds a Baseline Security Clearance.

  • Australian Health Practitioner Regulation Agency (Ahpra) – Prepared submissions and related tribunal documents for disciplinary and review matters referred by Ahpra under the Health Practitioner Regulation National Laws in relevant state/territory tribunals. Appeared and assisted Counsel in tribunal proceedings.
  • Australian Transaction Reports & Analysis Centre (AUSTRAC) – Prepared evidence briefs and supporting documents for money laundering investigations undertaken by Austrac under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).
  • The Australian Government Department of Health and Aged Care – Prepared in-house legal advice on matters relating to compliance with various legislation within the Department of Health and Aged Care portfolio and related Commonwealth government legislation. Also provided instructions on behalf of the Secretary of the Department of Health and the Minister for Health and Aged Care in civil litigation matters in the Administrative Appeal Tribunal, the Federal Court of Australia and the High Court of Australia.
  • Therapeutic Goods Administration – Undertook investigations into and sought compliance action against unlawful advertisement of nicotine vaping products, COVID-19 rapid antigen tests and medicinal cannabis products in contravention of the Therapeutic Goods Act 1989 (Cth) (the TG Act). Initiated civil penalty proceedings on behalf of the Secretary of the Department of Health in respect of contraventions of the TG Act and assisted in briefing the Commonwealth Director of Public Prosecutions in relation to criminal proceedings under the TG Act.
