Biography

Stela Hima Bailey is a disputes lawyer with a focus on commercial and construction disputes. She provides strategic resolutions-focused advice to owners, contractors and subcontractors in construction and engineering disputes.

Stela has comprehensive experience in the mediation, arbitration and litigation of commercial, industrial and large-scale infrastructure projects arising from contractual disputes, design issues, engineering issues, negligence of claims, construction deficiencies, and delay claims. Stela focuses on maximizing her clients' chances of success, which includes identifying cost-effective ways to resolve disputes without the time and risk of lengthy litigation or arbitration proceedings.

Stela also practises insurance and tort liability. She advises and represents parties on various lawsuits involving professional negligence, product liability, class actions and property losses.

  • Counsel for a design-build contractor in a dispute arising out of the design and construction of a major ring road project in southern Alberta
  • Counsel for the owner of a sulphur forming plant in an ICC arbitration involving a dispute with the EPC contractor regarding delay claims
  • Counsel for numerous plaintiffs in a complex nine-action matter arising out of negligence and breach of contract claims against the builder, engineer, permitting authorities and manufacturers concerning defective construction with structural insulated panels (SIPs)
  • Counsel for an EPC contractor involved in a dispute with the owner and operator of a carbon capture facility
  • Defence of claim for breach of contract and negligence arising out of the explosion and destruction of a decoking facility at the CNRL Horizon Projects in the oil sands
