Amsterdam advises RWE on €2.5bn acquisition of coal fired power plant

Our Amsterdam office has advised RWE Eemshaven Holding B.V. (RWE) on the acquisition of all permits and licences required for the installation of a 1600MW coal fired power plant in the Eemshaven, Groningen.

Our team has now represented RWE in more than 25 legal court proceedings in relation to the construction and operation of the coal fired power plant. This is unprecedented in the Netherlands and highlights included the pre-judicial proceedings before the European Court of Justice and obtaining a positive ruling for RWE.

We also assisted RWE in obtaining a new Nature Protection Act permit, which was granted on June 22, 2012, when RWE obtained all permits required for the power plant. These permits have all become irrevocable, with the exception of the Nature Protection Act permit. More than 6,000 parties filed objections against the Nature Protection Act permit and we successfully represented RWE in these objection procedures. We are currently assisting RWE in the appeal procedure against the Nature Protection Act permit, and on various other legal matters in relation to the installation of the coal fired power plant.
