Biography

Tim Kenny is Head of Intellectual Property, US, and is the former Head of IP Brands, US, and the former Global Head of Intellectual Property. He focuses on US and international trademark litigation, oppositions/cancellations, policing, counseling, licensing, prosecution and strategic portfolio counseling and management, copyrights, copyright litigation and unfair competition litigation on behalf of clients of all sizes in a wide variety of industries.

Tim has handled:

  • Approximately 125 federal intellectual property cases (approximately 85 of those cases involved trademark, trade dress, non-traditional mark, unfair competition and related matters; 10 of those cases involved copyright issues)
  • More than 200 Trademark Trial and Appeal Board (TTAB) proceedings
  • Hundreds of Uniform Domain-Name Dispute-Resolution (UDRP) proceedings
  • Thousands of trademark policing matters
  • The coordination of litigation and oppositions/cancellations in multiple countries
  • 10-15 temporary restraining orders (TRO) and preliminary injunction matters
  • Hundreds of depositions in trademark matters
  • Conducted numerous multi-day mock trials

At Hamline, Tim was Editor-in-Chief of the Hamline Law Review, a member of the Jessup International Moot Court team and Best Oral Advocate as a 1L. Tim is admitted to practice in the US District Court for the District of Minnesota, in numerous other federal district courts, and the US Courts of Appeal for the Eighth Circuit and Federal Circuit.

Litigation/Brand Protection:

  • Defended and successfully settled a trademark infringement case against a large Minnesota manufacturing company in the Southern District of Texas
  • Successfully defended a UK  consumer products company in trade dress infringement case brought by a leading US competitor in the Southern District of New York
  • Defended a UK/Cayman Island company in a trademark action in the District of Oregon obtaining a dismissal and negotiating a global co-existence agreement.
  • Represented industry-leading US food company against a Greek company regarding infringement of a famous mark.
  • Obtained a preliminary injunction in the District of Minnesota for an industry-leading food company against two Turkish companies and a US distributor involving infringement of a famous mark​
  • Developed and implemented global policing strategy for famous marks of Fortune 500 companies in the consumer products, health care and software/business analytics industries 
  • Obtained a favorable settlement for a well-known Minnesota architect in a copyright infringement suit against a developer who copied the appearance of one of the architect's copyrighted buildings
  • Represented a well-known Minnesota charter school pro bono in a trademark infringement action and prevented a West Coast charter school company from entering Minnesota and starting a new charter school under a confusingly similar name 
  • Obtained orders transferring domain names from cybersquatters to numerous clients through ICANN's UDRP proceedings
  • Obtained a TRO in the Central District of California against a cybersquatter who owned over 300,000 domain names and settled the case by obtaining a permanent injunction and significant monetary payment
  • Developed strategy for protecting non-traditional marks (color, product configuration, trade dress, etc.) for several Fortune 500 and medium-sized industry-leading companies and enforced those marks in U.S. federal courts and TTAB opposition proceedings
  • Prevented entry of a preliminary injunction in the Northern District of Illinois against an industry-leading home decorations company in a case involving complex, inter-related issues of trademark, copyright, contract and non-compete agreements between an artist and several companies
  • Obtained a favorable settlement for an industry-leading company in the clothing industry and its national retail customer in defense of a trademark case in the District of Minnesota
  • Obtained a favorable settlement for a leading consumer products company in a dispute against another consumer products company over the issue of the registration of the product configuration of a hot cup lid in a proceeding before the TTAB.
  • Obtained TROs and preliminary injunctions in the District of Minnesota for a large diversified technology, multinational company against a number of cybersquatters
  • Co-managed the trademark policing portfolio for a famous house mark of a Fortune 125 highly diversified client
  • Tried several TTAB trials.


Strategic Portfolio Management:

  • Manage a 3,000 + file global IP portfolio of a steelmaker and rail company
  • Manage a 560 + file US IP portfolio of a US online/television retailer
  • Manage a 2000 + file global IP portfolio on an industry-leading decision management and predictive analytics client​
  • Managed a 400 file IP portfolio of an industry leading consumer products client
  • Developed strategy and led efforts to have several marks declared legally famous
  • Counseled and assisted several industry-leading companies (business analytics, online/television retailers, steelmaker and rail company)  with all legal issues and action items relating to changing its corporate identity and house mark globally
  • Developed and implemented global trademark portfolio strategy for numerous large and medium-sized companies
  • Managed transfer and intake of numerous large IP portfolios
