Houston obtains take nothing jury verdict for EOG Resources

Our Houston office recently obtained a “take nothing” jury verdict for EOG Resources, Inc. (“EOG”) in a Fair Labor Standards Act case in the US District Court, Western District of Texas, San Antonio Division.

Plaintiff Jevan Snead (“Snead”) alleged that EOG improperly classified him as an independent contractor and failed to pay him overtime compensation. Although Snead tried to bring the case as a collective action on behalf of other independent contractors, he failed to do so. Snead also moved for summary judgment on liability, which we defeated.

The case was initially before Judge Orlando Garcia, but after jury selection, Judge Garcia transferred the case to Judge Xavier Rodriguez. On February 22, 2018, after a three-day trial, the jury returned a complete defense verdict in twenty minutes, finding that EOG was not liable on any of Snead’s claims.
