Thomas Moran is a partner in the litigation group, with a litigation and advisory practice that spans most aspects of commercial and corporate law.  His litigation practice focuses on trial, arbitration, hearing and appeal work in a broad range of commercial matters, including cases relating to real estate ventures, complex M&A transactions, and disputes involving forestry law and other natural resource matters.  Thomas also has significant experience with the law of defamation and has been counsel in complex civil fraud claims, corporate disputes at both the board and shareholder level, and disputes involving partnerships and joint ventures.  In addition, he acts for clients such as TELUS on injunction and other applications in connection with a variety of matters, including advertising and competition law issues.  Thomas has appeared before the Supreme Court of Canada and all levels of Court in British Columbia.

Thomas is actively involved in professional development both within the firm and in the legal community. He is the former chair of the Civil Litigation Subsection of the Canadian Bar Association in Vancouver, and has presented lectures on legal issues for lawyers and other professionals on a range of topics, including damages and other contract and tort law issues.

  • Weisstock v. Weistock, 2022 BCSC 209 (Supreme Court of British Columbia) – counsel in a petition proceeding seeking oppression and liquidation remedies in connection with a closely held company with extensive real estate assets
  • Alvaro v. InsureBC, 2021 BCCA 96 (Court of Appeal for British Columbia and Supreme Court of British Columbia) – counsel in respect of a denial of insurance coverage in connection with damages caused by a fire at a vacant premises
  • Brown v. Brousseau, 2021 BCSC 151 (Supreme Court of British Columbia) – counsel for the board of directors of an environmental preservation society, in a petition proceeding successfully challenging certain steps taken by the board's minority contrary to the society's bylaws and applicable legislation
  • TELUS v. Shaw, 2020 BCSC 1354 (Supreme Court of British Columbia) – counsel for TELUS in a claim alleging misleading advertising in respect of Internet services contrary to the Competition Act, seeking injunctive relief and damages
  • SunSelect v. Mastronardi, 2020 (Commercial Arbitration under VanIAC) – counsel for SunSelect in a commercial arbitration seeking general damages for breach of contract and misrepresentation in connection with a supply agreement for the commercial production of tomatoes in California
  • FortisAlberta Inc v EQUS REA Ltd., 2016 ABQB 307 (Alberta Court of Queen's Bench and commercial arbitration) – successfully upholding arbitration award and dismissing jurisdictional challenge
  • Crest Realty Westside Ltd. v W & W Parker Enterprises Ltd., 2015 BCCA 447 (Court of Appeal for British Columbia and Supreme Court of British Columbia) – successfully upholding judgment in respect of the sale of a commercial property, and dismissing defence of fraudulent misrepresentation
  • Merit Consultants International Ltd. v Chandler, 2014 BCCA 121 (Court of Appeal for British Columbia and Supreme Court of British Columbia) – successfully upholding the dismissal of an action against corporate directors involving defamation and a claim for inducing breach of contract
