In this video, Clio Angeli and Richard Whish KC discuss recent developments regarding dawn raids in EU and UK competition law investigations.  This includes discussion of the European Commission’s powers to copy and take away electronic data for review at the Commission’s premises, rights of defence in such circumstances for companies under investigation and a recent appeal regarding the need for the Commission to reimburse companies for relevant costs where an inspection moves from the site of the company to the Commission’s premises. 

The video also discusses whether dawn raids remain an effective investigation tool given so-called “data inflation” or targeted RFIs are a better approach.  Also discussed is the recent increase in dawn raids on domestic premises, including whether such raids will continue to be the exception rather than the norm and UK case-law regarding the standard of evidence needed to obtain a warrant for a raid on domestic premises.
