Biography

Victoria Corder is a commercial litigation partner in Norton Rose Fulbright's New York office.  Victoria focuses her practice on complex commercial disputes involving breaches of contracts, fraud and business torts. She has particular experience with issues unique to cross-border disputes as well as disputes governed by New York law and procedure, and has significant trial and arbitration experience, including first chair experience. She has represented and counseled companies in the financial services, reinsurance, technology, energy, and healthcare industries in every phase of litigation, arbitration and alternative dispute resolution.

  • Representing an aerospace industry maintenance, repair and overhaul provider in connection with disputes with its vendors over the sale of fraudulent OEM parts. 
  • Representing Nations Technologies Inc., a publicly traded Chinese technology company and its affiliates, in lawsuits filed in the Southern District of New York consolidated into Khan Funds Management America, Inc. et al. v. Nations Technologies Inc. et al.  Plaintiffs have alleged RICO and fraud claims premised on the alleged theft of US semiconductor technology, while Nations Technologies has counterclaimed for the return of US$80 million stolen from the company by Plaintiffs and seeks to enforce a Singaporean money judgment for US$34 million.  
  • Representing global insurance company in dispute with a reinsurer concerning two collateralized reinsurance contracts in a New York arbitration involving mutual claims for breach of catastrophic excess of loss treaties.  
  • Advised foreign merchant firm in connection with enforcing obligations in a contract worth several hundred million dollars and governed by New York law.
  • Advising London-based insurance company in recovery of cryptocurrency assets seized by the US government in connection with ransomware claims paid to US insureds under ransomware policies.
  • Represented Rabo AgriFinance in a contested Chapter 11 bankruptcy proceeding in the District of Idaho, In re: Millenkamp Cattle, concerning accurately valuing the debtor and assets. 
  • Represented Singapore-based company Mirana in the FTX adversary proceeding, FTX Trading LTD, et al. v. Mirana Corp., et al., in Delaware Bankrtupcy Court.  FTX was seeking the return of US$838 million of cryptocurrency and other assets.  Following motions to dismiss, successfully resolved all claims in a favorable settlement for Mirana.
  • Successfully represented privately held Canadian companies in a confidential ICDR arbitration seated in New York seeking to expel a shareholder former agent, terminate the parties' contracts and recover damages related to the diminution in value of the companies' art assets purchased for more than US$200 million dollars. 
  • Successfully represented global reinsurance company in a dispute with a cedant/captive insurance company that insured a US$30 billion complex property program.   Following a New York arbitration that Victoria First Chaired, the reinsurance company avoided payment of the full claim amount under the contract.
  • Represented a Japanese motor company in a parallel arbitrations: an ICC arbitration seated in New York concerning breaches of representations and warranties in connection with the sale of a billion dollar Brazilian business and an LCIA arbitration with its former owner/now customer concerning a purported breach of a supply agreement.  Obtained a favorable global business resolution for the client, avoiding the payment of tens of millions of dollars in alleged damages. 
  • Represented a Chinese company in a lawsuit in Delaware federal court seeking to enforce an unpaid promissory note.  Obtained judgment on the pleadings prior to discovery and an award for all damages including attorneys' fees and interest.
  • Represented Clearwater in dispute against insurer in New York federal court involving mutual claims of breach of contract and duty of utmost good faith.  Following a jury trial, the case was successfully resolved pending appeal.
  • Represented global pharmaceutical company in ICC arbitration for breach of a license and commercialization agreement based on respondent's failure to use commercially reasonable efforts to commercialize the pharmaceutical product.  Obtained complete award, including damages, termination of the license agreement, and an injunction requiring return of the pharmaceutical product. 
  • Represented Barrick and Rangold, global mining companies, in a US litigation filed by a London investment bank seeking to enforce a multi-million dollar oral fee agreement allegedly made in connection with the companies' multi-billion dollar mega-merger. Successfully obtained dismissal of lawsuit on personal jurisdiction grounds, which was upheld on appeal.
  • Represented global insurance company in lawsuit filed in New York federal court asserting a business interruption claim. Successfully resolved the dispute without motion practice.
  • Represented global company in contract dispute with an investor, which was governed by New York law, that arose in connection with the purchase of an oil and gas producer in Peru. Successfully resolved the dispute.  
  • Represented global defense company and US subsidiary in a purchase-price adjustment dispute with U.S.-based sellers for breach of representations and warranties in connection with a multi-million dollar acquisition of US operations. Successfully resolved the dispute.  
  • Represented global pharmaceutical company in contract disputes filed in New York federal court. Successfully resolved the disputes. 
  • Represented a US Senator against federal criminal charges of bribery and corruption that were ultimately dismissed with prejudice following a three-month long jury trial in the District of New Jersey that resulted in a hung jury.
  • Represented New York investment bank and employees in FINRA arbitration and parallel proceedings in New York state court filed by a competitor for breach of contract and theft of trade secrets. Obtained a complete victory against all claims and prevailed on all counterclaims. Successfully obtained dismissal of parallel proceedings. 
  • Represented global interdealer brokerage firm in various arbitrations (AAA and FINRA) and civil litigations (New York Supreme Court Commercial Division and New Jersey state court) arising out of a global corporate raid by a competitor and a related contract dispute over the alleged theft of data.
