Data breach-related class actions are a mainstay in US courts and do not appear to be going away any time soon.

As with civil litigation generally, most such cases settle rather than proceed to trial. Data breach class actions settled in federal court, however, can give rise to interesting jurisdictional issues, such as whether a court can order and oversee a settlement where plaintiffs’ standing has previously been challenged.
