Scott Henry Silver
Biography
Scott Silver is a senior associate in the litigation and disputes group. He assists clients on a broad range of commercial litigation matters, including issues related to breach of contract, shareholder rights, corporate oppression and commercial leases. Scott also has extensive experience in the defence of class actions, including in the areas of consumer protection and competition law. Scott regularly acts as counsel in commercial arbitrations, as well at both the trial and appellate courts, having appeared at all levels of court in British Columbia. Prior to articling with us, Scott clerked for the Honourable Chief Justice Skolrood at the British Columbia Supreme Court.

Scott has acted as counsel in the following matters:
- Counsel to multinational aluminum parts manufacturer in defence of a class action proceeding alleging price-fixing
- Counsel to Expedia in defence of a class action proceeding alleging “drip pricing”
- Counsel to Recochem in defence of a class action proceeding alleging breaches of the Business Practices and Consumer Protection Act
- Counsel to Pfizer in defence of a class action proceeding alleging breaches of the Competition Act and Business Practices and Consumer Protection Act
- Crowder v. British Columbia (Attorney General), 2019 BCSC 1824 – a successful constitutional challenge to Supreme Court Civil Rule 11-8
- Thomas and Saik'uz First Nation v. Rio Tinto Alcan Inc., 2022 BCSC 15 – this case involved the first Canadian environmental tort claim grounded in Indigenous rights, relating to the operation of a hydro-electric facility. Following a 189-day trial, the BC Supreme Court dismissed the plaintiffs' claims. The trial included evidence from 40 witnesses, more than 20 expert reports, and several thousand pages of written argument
- Weisstock v Weisstock, 2023 BCCA 18 – a successful application seeking a stay of proceedings
- Weisstock v. Weisstock, 2023 BCCA 352 – an appeal challenging a liquidation order under the Business Corporations Act
- Weisstock v. Weisstock, 2024 BCSC 2118 – a petition proceeding seeking the removal of a trustee
- Century 21 v. Real Estate Webmasters Inc, 2024 BCSC 518 – an application seeking to strike pleadings
