Biography

Sarah Gosling is a litigation and disputes lawyer based in London. She focuses on construction and engineering disputes in the energy sector and commercial international arbitration.

Sarah has experience in a wide range of dispute resolution forums including High Court and Court of Appeal litigation, ICC, LCIA, IChemE and ad hoc arbitration, adjudication and mediation. She spent six months on secondment to the Sydney office during her training contract, where she gained experience in the renewable energy sector across Asia-Pacific.

Litigation

  • Representing the claimant housing association in high court proceedings against a contractor concerning defective cladding in a tower block development (Martlet Homes Ltd v Mulalley & Co Ltd [2022] EWHC 1813 (TCC))
  • Representing the same claimant housing association in satellite court of appeal proceedings in respect of an application for an amendment to its particulars of claim (Mulalley & Co. Ltd v Martlet Homes Ltd [2022] EWCA Civ 32).
  • Representing a defendant housing association in multi-party high court proceedings brought by leaseholders regarding fire safety defects in a residential development in London.

Arbitration

  • Representing the purchaser of a ferronickel mine in LCIA arbitration proceedings concerning a c.£60m dispute over retained tax liabilities under a share purchase agreement.
  • Representing the respondent subcontractor in ad hoc arbitration proceedings comprised of c.£120m delay claims arising on a high profile defence industry project. 
  • Representing the respondent technology provider in ICC arbitration proceedings brought by the main contractor on a telecommunications project in the Philippines. Experience of examination in chief advocacy.
  • Representing the employer in IChemE arbitration proceedings regarding the defective design and operation of an energy from waste plant in the UK.
  • Representing a multinational consumer goods company in ICC arbitration proceedings concerning a dispute over the supply of raw materials for a pharmaceutical product.
  • Representing the respondent contractor in an ICC arbitration concerning disputes arising in relation to the design, supply and operation of a polymerization plant in the UK.
  • Representing the maritime subcontractor in an ICC arbitration for claims arising in respect of the construction of a liquefied natural gas terminal in South America.

Advisory/other

  • Representing a housing association in two adjudications concerning cladding and fire safety defects in its high rise building portfolio. Currently advising the same housing association on potential contractual and Building Safety Act 2022 claims of c.£3m arising in respect of a further external wall system.
  • Providing advice to a housing association on its prospects of bringing claims against a contractor in relation to defective cladding for the purpose of an application for funding from the Building Safety Fund.
  • Advising the Employer in connection with its termination rights in relation to a renewable energy project in the UK.
  • Advising a JV partner in relation to the crystallisation of a dispute under various contractual documents relating to an oil and gas project in Africa.
  • Advising an employer on the merits of several delay claims arising in connection with a solar project in Qatar.
  • Advising a contractor in relation to its exit from, and settlement of, claims arising under two construction contracts for a residential development and related infrastructure.
